Valington Homes Reacts to FCT High court Judgement Delivered by Justice E. Okpe, heads to Appeal Court.


Valington Homes, a leading Real Estste and property company in Nigeria, has reacted to a recent judgement of the Federal High Court, FCT regarding a land dispute.

The statement reads;

REJOINDER ON THE JUDGMENT OF COURT 25  NYANYA HIGH COURT OF FCT DELIVERED BY HIS LORDSHIP JUSTICE E. OKPE ORDER ON 26th DAY OF JUNE 2024


We want to guide the general public and our numerous Clients that we the Defei in the above mentioned Judgment that both “Stay of Execution” and “Notice of Appeal” Unit has been entered to challenge this very unmerited Judgment of the Lower Court in favour of the Claimant – Adebayo Opabiyi which was Characterised with technicality in law and lack of fair hearing in line with  Section 36 (1) of the  1999 Constitution of Federal Republic of Nigeria against the Defendant – Valington Homes and Properties Ltd,


Based on the above facts,  Valington Homes and Properties Ltd, hereby urge the general public to  disregard the the said Court’s Judgment and it’s award by ordering the Deto pay a fine of N10 million for trespassing on a plot of land allocated to Adebayo Opabiyi by the FCT authorities, in addition to N500,000 in legal costs and it reads…


We as the  Defendant have filed an Appeal before the  Appeal Court Abuja challenging the Lower Court’s judgment. We have the confident that the Appellate Court will review the case and rule in our favour on the following grounds of law.


1. The FCT High Court ruled that the plaintiff had a Land Allocation document on the said land in contention dated January 2001 while that of  Valington Homes was issued by the FCT dating March 2001 and for that reason the Plaintiff was the owner of the land in contention without verifying whether the Plaintiff paper was genuine. 


2. The documents of the Plaintiff doesn’t have TDP and Survey Plan approved  by FCDA while that of Valington Homes has the TDP and Survey Plan approval from the FCDA this in essence shows that the Plaintiff’s document is not genuine.
